1. Acceptance of Terms
By accessing our website, requesting a consultation, or hiring Zazueta Landscape (“Company,” “we,” “us,” or “our”) for landscaping, hardscaping, softscape, woodwork, concrete, lighting, or maintenance services, you (“Client,” “you,” or “your”) agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, please do not use our site or engage our services.
2. Scope of Services
Zazueta Landscape provides residential and commercial landscaping services across San Jose, California, and surrounding areas. Services include, but are not limited to:
- Design & Installation: Landscape design, softscaping, irrigation, planting, soil amendment, and residential vineyard installation.
- Hardscape & Structural: Pavers, custom patios, driveways, walkways, concrete work, retaining walls, and water features.
- Woodwork: Fences, decks, vegetable boxes, trellises, and arbors.
- Lighting: Low-voltage outdoor landscape lighting design, installation, and maintenance.
- Maintenance Services: Weekly, bi-weekly, or monthly residential and commercial groundskeeping, lawn care, tree/plant pruning, weed control, fertilization, aerating, power washing, and system maintenance.
Specific service deliverables, pricing, timelines, and material selections for a project will be outlined in your individual written proposal, estimate, or contract agreement.
3. Consultations, Estimates, and Contracts
- Estimates: Initial site assessments and consultations result in a written estimate. Estimates are valid for 30 days from the date issued, unless otherwise stated in writing.
- Project Execution: A project is formally scheduled only upon the signed acceptance of an estimate/contract and receipt of any required initial deposit.
- Permits: Unless explicitly stated in writing within the project contract, the property owner is responsible for identifying, securing, and paying for any required municipal permits or Homeowners Association (HOA) approvals.
4. Client Responsibilities & Site Access
To ensure safe and efficient execution of work, the Client agrees to:
- Grant full physical access to the property during normal operational business hours (Monday – Saturday, 7:00 AM – 5:00 PM).
- Ensure that the work area is clear of personal items, pets, vehicles, debris, and hazards prior to crew arrival.
- Clearly disclose and mark all underground utilities, private irrigation lines, electrical lines, or drainage paths not covered by public utility mark-outs (811). Zazueta Landscape is not liable for damage to hidden, unmarked, or improperly buried private lines.
5. Payment Terms & Licensing Compliance
- Payment Schedule: Payment milestones, including initial deposits, progress payments, and final balances, will be strictly defined in your specific project contract.
- Late Payments: Outstanding balances not paid in accordance with contract terms may incur late fees or interest charges as permitted under California law.
- California Contractors State License Board (CSLB) Compliance: Zazueta Landscape operates fully licensed under CA Lic. #990867. All work is performed in compliance with California Business and Professions Code standards.
6. Scheduling, Weather, and Delays
While we make every effort to adhere to agreed-upon project schedules, delivery dates and work timelines are estimates only. Zazueta Landscape is not liable for delays caused by:
- Adverse weather conditions (e.g., heavy rain, extreme heat).
- Material shortages, supply chain disruptions, or delivery delays.
- Unforeseen site conditions (e.g., unexpected sub-surface rocks, root systems, or unstable soil).
- Delays in client approvals or permit issuance.
7. Warranties and Plant Care
- Craftsmanship & Construction: Hardscape, concrete, woodwork, and structural installations are backed by the specific warranty terms outlined in your signed client agreement.
- Living Plants & Turf: Softscape elements (plants, shrubs, trees, sod) require proper ongoing care, watering, and maintenance. Zazueta Landscape is not responsible for plant failure resulting from extreme weather, improper client watering practices, pest infestations, unauthorized chemical applications, or lack of maintenance following completion of installation.
8. Communications & Opt-In Terms
By submitting your contact information through our website consultation forms, you authorize Zazueta Landscape to contact you regarding your inquiry via phone, SMS, or email.
- We respect your privacy and will never share your personal information with third parties for marketing purposes.
- You may opt out of promotional communications at any time by following the unsubscribe instructions or contacting us directly at 408-603-4061.
9. Limitation of Liability
To the maximum extent permitted by California law, Zazueta Landscape, its officers, employees, and subcontractors shall not be liable for any indirect, incidental, consequential, or punitive damages arising out of or related to the use of our website or services. Our total liability for any claim arising out of a project shall not exceed the total amount paid by the Client to Zazueta Landscape for the specific services rendered under the applicable contract.
10. Property Rights & Website Content
All design concepts, proposals, custom site plans, text, imagery, and code appearing on the Zazueta Landscape website are the property of Zazueta Landscape and protected by copyright law. Unapproved duplication, redistribution, or reproduction of content or design blueprints is strictly prohibited.
11. Governing Law & Dispute Resolution
These Terms are governed by and construed in accordance with the laws of the State of California, without regard to conflict of law principles. Any legal action or proceeding arising under these Terms shall be brought exclusively in the state or federal courts located in Santa Clara County, California.
